As children are back in school for the 2021-2022 school year, they look forward to a time of new beginnings and friendships; new goals and dreams; as well as new supplies, clothes, and shoes. Unfortunately, the delta variant has also made it a time of renewed caution.

Last year I posted back to school article on the importance getting an medical power of attorney and HIPAA release. It’s just as important now as it was then. Especially if you’re working in schools, or have school age children.

College Students and Adult Children

Because the Health Insurance Portability and Accountability Act (HIPAA) forbids health care providers from giving out patient information; you will have no way of helping your adult child in case of a medical emergency.

For those of you with recent graduates and adult children, I recommend having them sign a medical power of attorney with you as the agent. Only a signature is necessary for a Colorado medical power of attorney to be valid. (It is not required it be notarized or witnessed.) And since a suitable Colorado medical power of attorney can easily be found on the Internet. In a pinch you could always have your kid print one out and sign it. 

Of course this is not the preferred method. Preferably the document should be professionally prepared as well as witnessed and notarized; ensuring acceptance in all jurisdictions.
